Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Gym Hero mobile application ("the App") operated by Daniel James Tronca ("us", "we", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use the App.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

3. Use of the App

Gym Hero is provided for personal, non-commercial use only. You agree not to misuse any features of the App or interfere with its normal operation.

4. Account and Data

Gym Hero does not require account creation. All user data is stored locally on your device or optionally synced via your personal iCloud account. You are responsible for maintaining the security of your device and any data stored within the App.

5. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Daniel James Tronca. The App is protected by copyright, trademark, and other laws of both Italy and foreign countries.

6. App Store Compliance

These Terms are between you and Daniel James Tronca, not with Apple Inc. ("Apple"). Apple is not responsible for the App and its content. However, you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms.

7. No Warranty

The App is provided "as is" without warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

In no event shall Daniel James Tronca be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
